  • What is Lis Pendens?

    • Times have been hard and the pandemic has wreaked havoc on many of us and if you stopped making mortgage payments on your house, then your lender may have filed a lis pendens, They are starting the process to seize your home. This is known as foreclosure.

      The notice of default or a lis pendens, usually occurs after 3 consecutive mortgage payments have been missed, but can happen at the lenders discretion. Lis pendens is filed and becomes part of the public records as a constructive notice. You should have received a letter in the mail of default and I am sure your lender had been calling you to make payments.

      The length of time lis pendens is filed until the foreclosure process occurs can be as short as a few months so waiting is NOT an option. This will NOT go away on it's own, so choosing to ignore it will lead to foreclosure and you being evicted from the home.

      Don't panic, there are ways out. You may have already been contacted by cash offer companies with quick fixes, but don't panic. You can still potentially sell your home traditionally with blessings from your lender or all parties involved.
